Max, a retired bus driver, signed up for a tour of South America. When his group got off the plane in Caracas, Max's luggage was missing.
"My suitcase has medication I need for my heart condition," complained Max.
A smiling airline official nodded apologetically. "It may turn up in a day or two," he said.
But 10 days and three cities later, the luggage was still missing.
"My vacation was ruined," cried Max when he returned home. "I'm suing the airline for the physical and mental distress I suffered."
If you were the Judge, would you let Max recover from the airline?
Max wins $50,000 from the airline. "The plaintiff can recover damage for the time and inconvenience of trying to replace his clothing, for his repeated trips to the airport to inquire about his luggage, and for the physical and mental distress caused by lack of medication," said the Judge. (Based on a Federal Appeals Court case.)
